LAHORE, Nov 4: Police and other
law-enforcement personnel launched a crackdown across the country on Sunday,
apparently fearing a large-scale protest campaign against imposition of
emergency.
Opposition politicians, prominent lawyers and rights activists were detained in
large numbers in several cities and towns of the country.
Prominent among those detained included PML-N acting president Javed Hashmi, ANP
chief Asfandyar Wali Khan, former ISI director-general Gen (retd) Hameed Gul and
rights activists I.A. Rehman and Iqbal Haider and hundreds of other people on
the second day.
Police detained over 600 people in Lahore. Javed Hashmi was arrested from Multan.
I.A. Rehman and Iqbal Haider were lodged at Asma Jehangir’s house. Ms Jehangir
has been under house-arrest since Saturday evening.
Around 70 civil society activists were arrested when they gathered at a Joint
Action Committee meeting of the HRCP in Garden Town to discuss the situation
after the imposition of emergency.
Lahore District Bar president Mohammad Shah, Lahore High Court Bar Association
president Ahsan Bhoon, advocates Ashtar Ausaaf, Khalid Hussain and Iftikhar
Bhatti were also arrested.The Pakistan Muslim League (Nawaz) and the Pakistan
Tehrik-i-Isnaaf claimed that over 1,200 and 50 activists, respectively, had been
detained in two days of crackdown.
In Rawalpindi, police rounded up nearly 60 people, including a retired judge,
the former ISI director-general, lawyers and human rights activists.

3: President General Pervez Musharraf, in his capacity as the chief of army
staff, on Saturday declared emergency rule in the country, suspended the
country’s constitution, and issued a new Provisional Constitutional Order (PCO |

According to some details of the new PCO made available to
the media, the National Assembly, Senate, provincial assemblies, the prime
minister, provincial chief ministers, federal and provincial ministers,
governors and all those in the “government services” will continue to function
normally.However, it was not clear how this will be possible, or be legitimate,
with President Musharraf resorting to the extra-constitutional action of
suspending the constitution and issuing his own provisional constitutional order
or PCO.
Soon after the proclamation of emergency by Gen Musharraf, a seven-member bench
of the Supreme Court, headed by Chief Justice Iftikhar Chaudhry, reportedly set
aside the decision. Setting aside General Musharraf’s proclamation of emergency,
the panel asked all members of the superior judiciary against taking oath under
the new PCO.The Supreme Court, in its order, termed Gen Musharraf’s action
“illegal and unconstitutional” and asked the corps commanders and all civil and
military officials not to take oath under the PCO. Till filing of this report,
the judges of the SC were still inside the court building.
However, under the circumstances chances of a major rebellion on part of the
superior judiciary appeared highly unlikely. In any case, legal experts said,
the government must have contemplated such a resistance, and as has been the
past practice during military rule, some of the judges will not be invited to
take oath, some will refuse, and a few will accept the new order to provide
legitimacy to the this kind of emergency rule. In a latest development Justice
Abdul Hamid Dogar was sworn in as a Chief Justice of Pakistan by the President.
There were also reports that some of the lawyers, including the president of the
Supreme Court Bar Association, Chaudhry Aitzaz Ahsan, have been taken into
custody. Mr. Ahsan’s wife told reporters that her husband was arrested soon
after the imposition of emergency.Although news of a possible emergency rule had
been doing rounds for the past several days, on Saturday it became quite evident
when a large contingent of paramilitary troops started to arrive in Islamabad,
and cable operators were asked to pull the plug on all independent news
channels, including DawnNews, Geo, ARY and Aaj TV.
Land telephone lines and mobile phones are also partially down in Islamabad and
communication has become almost impossible in many parts of the capital. TV
channels and newspapers had been reporting for the past few days that the
government had made up its mind to declare emergency rule.

16.03.2007 - AT last the Badnam (Notorious) Punjab police attacked the offices of GEO TV and Jang publications. Now President of Pakistan and whole Line of stooges under him also condemns this act. But is this possible to attack a big and known publication without higher consent.
We condemn this act and ask Minister of information Mr. Durani who was lying all the time on different channels that there is freedom of information, is this freedom of information and what to say about Justice minister Mr. Wasi Zafar who is not only beating poor waiters and passengers at airport , now he is banning journalists on open TV screen and on air. Now when journalists have declared to register case against him and news about appointment of new Law Minister are in air he apologized on Geo TV and invited Ansar Abbasi (journalist) to dinner. Mr Minister what about poor waiter and passenger whom you have beaten.
What about Interior minister of Pakistan who is responsible fro this bloody police. We do not demand resignation of these ministers , because party is over now.

According to Daily Khabrain, Pakistan, Chief Justice Iftikhar Muhammad Chaudhry of Pakistan was pulled by his hairs a SHO of Sectriate Police Station Mr. Ruhksar Mehdi and was helped by some other police men who tried to pull Chief Justice Iftikhar Muhammad Chaudhry in car but due to Chief Justice Iftikhar Muhammad Chaudhry wife they were not able to so.
Mr. Justice was coming to Supreme Court by foot and was accompanied by Islamabad's highest Police chief I G Police Islamabad,, but Ruhksar Mehdi was encouraged by an army officer who was Captain by rang to use Usual Police Protocol which is used on Pakistani public daily. That petty police S H O even did not respect his boss I G who was walking with side of Chief Justice .

Non-functional Chief Justice of Pakistan, Justice Iftikhar Muhammad Chaudhry has demanded an open trial
ISLAMABAD: Non-functional Chief Justice of Pakistan, Justice
Iftikhar Muhammad Chaudhry has demanded an open trial on the reference filed
against him by the President General Perez Musharraf.
During a meeting with Tehreek-e-Istaqlal Chairman Air Marshal(retd) Asghar Khan
on Sunday Justice Iftikhar Muhammad Chaudhry expressed his desire for an open
trial. When contacted Air Marshal (retd) confirmed this demand by the
non-functional Chief Justice.
"The non-functional Chief Justice has demanded to hold an opentrial on the
reference," he told media.
Air Marshal Asghar Khan went to see the non-functional ChiefJustice at Chief
Justice House on Sunday and stayed with him for half an hour. Asghar Khan said
the non-functional Chief Justice was in good health and was staying with his
family members.
"It was my first meeting with the Chief Justice (non-functional). I went to the
Chief Justice House and was allowed to meet Iftikhar Muhammad Chaudhry after
completing the routine procedure by the officials deputed there," Asghar Khan
said. He said, son of the non-functional Chief Justice was also present during
the meeting.
Asghar Khan said, he inquired about the health of Justice Iftikhar Muhammad
Chaudhry and discussed with him the prevailing situation. He also informed that
telephone lines of the Chief Justice House have been disconnected.
A big blow to the
judiciary
WITH the Chief Justice of Pakistan having become “non-functional”, another
sordid chapter has been added to the judiciary’s chequered history. Ghulam
Mohammad began the process of destroying the foundations of Pakistan’s
constitutional and democratic structure, but he is not known to have interfered
with the judiciary. That the Sindh Chief Court tried to undo the dissolution of
the Constituent Assembly in October 1954 showed that the judiciary till then had
acted independently. However, the Federal Court then came to his rescue with the
notorious ‘Doctrine of Necessity’ that has since held the ground. Indeed with
his arbitrary actions that shook the very foundations of Pakistan, Ghulam
Mohammad had laid down a perverse tradition which military and civilian despots
have used shamelessly to prolong and consolidate their rule by resorting to
extra-constitutional methods. As years wore on, the judiciary more or less
acquiesced in its role as a subservient institution whose duty was to legitimise
every authoritarian ruler’s assumption of power, even if he acquired it by means
of a military coup, and to uphold all his actions which often were in utter
violation of the fundamentals of law and constitutional propriety. That is how
the Doctrine of Necessity became an intrinsic part of Pakistan’s constitutional
jargon, for, instead of being forgotten as a one-time exception, this doctrine
has been exploited by the generals, who often found — barring some exceptions —
willing allies of the judiciary.
Generals Ayub, Zia and Musharraf all overthrew elected governments. While the
Noon ministry, which Ayub and Iskander Mirza combined to dislodge by a coup, was
not directly elected, it had, nevertheless, enjoyed a majority in the assembly
and had a constitutional status, but Zia and Musharraf overthrew governments
which had come to power through general elections. Once in power, they de-fanged
the courts by appointing yes men to the apex judiciary so as to ensure
uninterrupted legitimisation of all their actions. Zia was a class by himself.
He not only got rid of five judges of the Supreme Court, he also sacked Chief
Justice Mohammad Yaqoob Ali. Zia also made no secret of his fascist bent of mind
by declaring publicly that the 1973 Constitution was a scrap of paper which he
could tear up any time. The Provisional Constitutional Order and the Revival of
the Constitution Order were not at all what their imposing titles suggested;
they were instruments of manipulation to perpetuate his rule which he had
assumed initially for 90 days to hold elections. Finally, the Constitution he
left behind as his legacy had little resemblance with the Constitution enacted
by the National Assembly in 1973. Instead, it had been stripped of its
parliamentary character, all powers were concentrated in his person, and like
Gen Musharraf today, he continued to remain both army chief and president till
his death. The amended Constitution contained a new Article — 58-2b -- which
authorised Zia to sack an elected government, which he did by dismissing the
government of his protégé, Mohammad Khan Junejo.
The most shocking part of Pakistan’s judicial history is the post-Zia period
when the popularly elected prime ministers, Benazir Bhutto and Nawaz Sharif,
showed scant respect for the concept of an independence judiciary and staffed it
with yes men. Where a judge or two refused to bend, they were got rid of. It was
also during this era — when Nawaz Sharif was prime minister — that the hoodlums
of the ruling party attacked the Supreme Court premises and made the Chief
Justice flee for his life. Those leading the hooligans were later tried and
given light sentences. Today they are back in business. The drama surrounding
Chief Justice Sajjad Ali Shah’s ouster from office and the role played by
“brother judges” made a mockery of the judicial norms and are a shameful part of
Pakistan’s history. The “brother judges” combined to get rid of their own chief
for political reasons. But both the civilian prime ministers were held
accountable for their conduct.
Now coming to Friday’s episode, one is appalled to see the photograph of a
general in uniform calling the country’s Chief Justice to his “camp office” as
if the latter were a ‘suspect’ in a case of embezzlement, thus stripping him of
the dignity to which he was entitled to by virtue of the office he held. Chief
Justice Iftikhar Mohammad Chaudhry was then not allowed to return to his office
and was “escorted” home. Gen Musharraf has made a reference against him to the
Supreme Judicial Council, and the media has published a list of the alleged acts
of malfeasance by Mr Justice Chaudhry. Since the charges are sub judice and
commenting on them would constitute ‘contempt’, one cannot but take note of the
background against which the Chief Justice was made “non-functional” and the
“judicial activism” that came to be associated with his name since he became
chief justice in June 2005. More important, it is difficult to avoid the
suspicion that some of his verdicts had irked the government and for that reason
it did not wish an independent Chief Justice to be in office at a time when the
apex court could be called upon to decide vital constitutional issues in the
light of continued reports that President Musharraf will retain the two offices
and that the existing assemblies will re-elect him as president for another
term. In some other cases, too, he had been bold — like reversing the sale of
Pakistan Steel, stopping the decision of the Capital Development Authority to
turn a public park into a mini-golf course, and taking suo motu actions to make
some highly progressive and popular decisions concerning human rights, women and
environment. However, the decision that must have hurt the government relates to
“disappearances”, of which there have been quite a few in the context of the war
on terror.
While SJC will, no doubt, decide upon the case whose outcome will have profound
consequences for the future course of law and constitution in Pakistan, the
nation is appalled that those who impose accountability on others and imprison
politicians are accountable to no one. Is not the nation justified in wondering
why the men in khaki consider themselves above accountability? He who seeks
justice must come with a clean hand is an old axiom. The generals seek to dole
out justice to others, but they themselves are not prepared to present
themselves before an impartial, civilian tribunal to defend their actions. It is
for this reason that, since Zia’s days, the word ‘accountability’ has acquired a
strange connotation because it is hard to dispense with the notion that the
military uses the shibboleth of accountability to persecute the regime’s
political enemies through what can be called inquisition courts.
A larger question is Pakistan’s image. The government has been very keen to
project a soft image for Pakistan, and there is no doubt that this country gets
bad press abroad, often because the good here does not make news, while
terrorism, honour killings and gang rapes regularly hit world headlines. But
then the nature of the regime in power is a major factor in giving the country a
good or bad image. Friday’s treatment of the Chief Justice is hardly the episode
that will cast Pakistan in a better image abroad. In fact, it will have a
negative impact on the world and add to the impressions abroad that Pakistan is
just another Muslim country where the ruler’s word is the law.

By Naveed Ahmad ISLAMABAD: The families and friends of the missing persons on Monday revealed that they have got more evidence about their loved ones being held in various “safe houses’ of the military intelligence. Though the government did not provide any details about the missing persons in the Supreme Court despite its clear directions, the Defence of Human Rights (DHR) NGO claimed to have received fresh information about the locations of the missing persons from a few recently released citizens. Amina Masood of the DHR told The News that she has met a recently released person who had seen her husband, Masood A Janjua, “several times in a Military Intelligence (MI) detention centre in Rawalpindi”. According to the DHR, some of the other detainees seen by the recently released citizens include Muhammad Mansoor, Saud Memon, Ali Hassan (Abdul Qadir), Aslam Zahid, Shokat Hayat, Osama Nazir, Ansar, Abdul Basit, Habeeb, Adeel, Siddque Akhter, Mufti Muneer, Saifullah Akhter and Mehboob Ilahi. The NGO learnt from the recently released person that Saud Memon, Muhammad Mansoor, Ali Hassan Rana, were seen in the ISI custody in Lahore, whereas Abdul Basit, Osama Nazir of Faisalabad and Hafiz Tahir of D I Khan are reportedly with the MI in Rawalpindi. Amina said she has learnt from her interviews that Aslam Zahid of Qasur was seen in the Army custody when he was abducted by the agencies along with his father Mufti Muneer Shakir. Speaking to The News, she said their protests are building up pressure on the government. On the Eid day, the families held a protest demonstration outside the Faisal mosque and also unsuccessfully tried to pay visit to the Aiwan-e-Sadr and the Prime Minister House. She said as the people are learning about this organised movement for the release of the innocent persons abducted by the agencies, more and more such families are contacting the NGO.
